Decree “Magicobus 2”

The Decree No. 2025-619 of 8 July 2025, known as “Magicobus 2”, aims to simplify and modernize civil procedure.

For investigative measures under Article 145 of the French Code of Civil Procedure, jurisdiction is now restricted, in real estate matters, to the court where the property is located. While this modification may lead to congestion in courts within areas of high real estate activity (such as Paris and other major metropolitan regions), it could also ensure better consideration of local specificities, given that experts will be appointed within the jurisdiction concerned and placed under the supervision of the local court.

The decree also limits the principle of oral hearings in certain proceedings where legal representation is mandatory and all parties have already submitted written pleadings. This development raises significant practical uncertainties, particularly in summary proceedings or before the enforcement judge.

Most of the new provisions will enter into force on 1 September 2025 and will apply to pending cases as of that date.
